Re:  Election Office Case No. P-736-LU320-NCE

 

Gentlemen:

 

On April 18, 1996, the Election Officer received a letter from Local Union 320 member Mark E. Erickson which was docketed as a pre-election protest, pursuant to

Article XIV, Section 2(b) of the Rules for the IBT International Union Delegate and Officer Election (Rules).  In the letter, Mr. Erickson alleged that persons connected to General President Ron Careys re-election campaign campaigned at various Local Union 320 meetings and in the IBT magazine.  He further stated that orders of the Election Officer have chilled campaigning by others in the local unions re-run election and questioned whether the Rules limit First Amendment rights of members.

 

Mr. Erickson has since stated that he did not intend his letter to be a protest.  He did not object to the alleged campaigning that he cited.  His position is that orders of the Election Officer have prevented more campaigning, which he would favor.  He has asked that the protest be withdrawn.

 

Accordingly, the protest is WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
