Re:  Election Office Case No. P-797-LU623-PNJ

 

Gentlemen:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) by William Morris, a member of Local Union 623.  Mr. Morris alleges that Local Union 623 President Mike Hennessy, Trustee Larry Dubin and member Bill Rothley removed campaign literature posted by Mr. Morris on a public street and, later, attempted to provoke a physical confrontation with

Mr. Morris over the literature’s removal.  Mr. Morris now advises the Election Officer that he wishes to withdraw his protest.  The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

 

Accordingly, the protest is WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
