Re:  Election Office Case No. P-1074-LU284-CLE

 

Gentlemen:

 

James P. Hoffa, a member of Local Union 614 and a candidate for general president, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules).  The protester alleged that a rally/fundraiser for Ron Carey, a candidate for general president, held on Sunday, October 13, 1996 at the Local Union 284 meeting hall, constituted an improper campaign contribution since the Hoffa campaign was not notified of the availability of the hall for campaign use.  The local union has since provided Mr. Hoffa with a letter that was sent to each campaign notifying them that the hall could be used for a fee of $300, as well as a copy of Mr. Careys acceptance and payment.  Mr. Hoffa now advises the Election Office that he wishes to withdraw his protest.

 

The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
