Re:  Election Office Case No. P-1096-LU299-MGN

 

Gentlemen:

 

James P. Hoffa, a member of Local Union 614 and a candidate for general president, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules).  Mr. Hoffa alleged that employees of Cassens Transport Company (Cassens) were being threatened with discharge for placing pro-Hoffa campaign material on bulletin boards and personal property, such as tool boxes, in violation of the RulesCassens has now agreed to allow employees to place campaign material on their personal tool boxes.  Therefore, Mr. Hoffa has advised the Election Office that he wishes to withdraw his protest.

The Election Officer, finding that the withdrawal effectuates the purposes of the Rules, permits the protest to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
