Gentlemen:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) by Kenneth L. Henry, a member of Local Union 414.  In his protest, Mr. Henry stated that he had been placed on unpaid suspension by his employer, Indiana Safety Training and Educational Trust Fund, after distributing campaign literature in support of James P. Hoffa, a candidate for general president.  Following the filing of this protest, Mr. Henry and the parties to this protest reached a settlement concerning the actions taken against Mr. Henry.  Mr. Henry now advises the Election Office that he wishes to withdraw his protest.

 

The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
