Re:  Election Office Case No. P-1166-LU328-MGN

Gentlemen:

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules

for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) by

Joel Secrist, a business agent of Local Union 328.  In his protest, Mr. Secrist alleged that he was terminated from his position as business agent at the local union in retaliation for his support of General President Ron Carey for reelection.  Mr. Secrist has now advised the Election Office that he wishes to withdraw his protest and pursue other remedies for his discharge.

The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
