Gentlepersons:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules

for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) by Doreen May, a member of Local Union 166.  Ms. May alleges that Lloyd Ring, an assistant warehouse manager working in Price Costcos Moreno Valley store, prohibited employees from posting campaign material on union-employee bulletin boards and wearing campaign buttons. 

 

This protest was investigated by Regional Coordinator Dolly M. Gee.

In a letter dated December 4, 1996, Price Costco agreed that its Moreno Valley facility would allow its employees to wear campaign buttons and to post campaign materials on the union/employee bulletin boards through the end of the International Brotherhood of Teamsters election process, which is anticipated to end on December 11, 1996.  Thus, Price Costco has agreed to permit all IBT members to wear campaign buttons and to post campaign materials on union-employee bulletin boards to the extent mandated by the election Rules.

 

Accordingly, this protest is RESOLVED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
