Re:  Election Officer Case No. PR-111-LU115-NYC

 

Gentlemen:

 

Donato J. De Santi, president of Local Union 701 and a candidate for International vice-president, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against the following individuals: John P. Morris, secretary-treasurer of Local Union 115; Joseph Yeoman, president of Local Union 331; Joseph J. Sullivan, president of Local Union 470; and John J. Jackson, president of Local Union 676.

 

Mr. De Santi alleges that Local Unions 115, 331, 470, and 676 failed to provide him with lists of all the work sites in violation of the Rules.  Messrs. Morris, Yeoman, Sullivan, and Jackson claim that they never received any request for lists from the protester.

 

The protest was investigated by New York City Protest Coordinator Barbara C. Deinhardt.

As evidence of the violation, the protester submitted copies of two letters that he states were mailed and faxed by the Hoffa/De Santi Rerun Campaign to five local unions (115, 331, 470, 676, and 463) requesting lists of work sites for the purpose of campaigning.  Only Local Union 463 complied with Mr. De Santi’s request.  The remainder of the locals failed to respond within the five-day (5 day) time frame required by Article VIII, Section 1(b) of the Rules.

 

Mr. De Santi has informed the Election Officer that he has now received current work site lists from Local Unions 115, 331, 470, and 676.

 

Accordingly, this protest is RESOLVED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one (1) day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
