Gentlepersons:

 

Gillian Furst, a member of Local Union 544, filed a pre-election protest pursuant to the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against Honeywell, Inc.  The protester alleges that on October 7, she and another Honeywell employee were advised they could not leaflet for Tom Leedham, a candidate for general president inside the plant doors at the Golden Valley Honeywell plant, despite a longstanding pre-existing right to engage in such campaign activity.

Honeywell responds that it has had a consistent policy of prohibiting campaigning inside its facilities.

 

The protest was investigated by Regional Coordinator Judith E. Kuhn.

 

After the protest was filed, the Regional Coordinator had several discussions with Deborah B. Hilke, Honeywell’s Senior Attorney in Human Resources.  On November 2, 1998, Ms. Hilke agreed that Honeywell would resolve the protest “by allowing orderly distribution of campaign literature by Honeywell employees in the areas between exterior doors and guard desks.  This resolution is without prejudice and is not an admission of any sort.”

 

Based upon Honeywell’s resolution, the protester has advised that she wishes to withdraw her protest.    The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN. 

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one (1) day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
