Gentlemen:

 

Denis J. Taylor, president of Local Union 355, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against fellow Local Union 355 member Joseph Rockstroh.  Mr. Taylor alleges that Mr. Rockstroh distributed copies of an official IBT publication entitled the Teamster Warehouse News at the same time that he was distributing campaign literature in support of the Tom Leedham “Rank and File Power” Slate, in violation of the Rules.

On January 7, 1999, the Election Officer received a letter from Mr. Taylor in which he expressed a desire to withdraw the protest.  The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one (1) day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
