Re: Election Office Case No. PR-406-IBT-EOH

Gentlepersons:

 

Garnet Zimmerman, a candidate for Teamsters Canada Vice-President, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules) against Sherene Kornhass and Ron Douglass, employees of Teamsters Canada, and Betty Grdina, an attorney in the IBT Legal Department.  The protester alleged that by seeking the names and addresses of Teamsters employed by Purolator Courier, the charged parties were seeking to assist the Louis Lacroix Team Canada Slate in violation of the Rules.

 

After the Deputy Election Officer Benetta M. Mansfield advised the protester that it was the Election Officer who sought the information from  Purolator Courier, the protester advised the Election Office that he wished to withdraw the protest.  The Election Officer finds that the withdrawal effectuates the purpose of the Rules and permits the protest to be WITHDRAWN. 

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one (1) day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
